CURRENT LAW

Summary: 

Although written with a language that implies Exclusive Scope of Practice, there is an exemption in this law that renders it a law without exclusive scope of practice. The stated scope of practice and the listed requirements outline a law that licenses Dietitians only with no licensure pathway for non-RD nutritionists. However, there is an exemption for “a person who furnishes nutrition information, provides recommendations/advice concerning nutrition and is not using the titles “licensed dietitian” or “registered dietitian”. Although licensure is no longer a requirement for providing nutrition care, only those individuals who qualify for licensure are eligible for insurance reimbursement. In addition to the exemption for nutrition professionals, this law does not apply to a licensed physician, dentist, nurse, dispensing optician, optometrist, occupational therapist, practitioner of respiratory care, physical therapist, podiatric physician, psychologist, marriage and family therapist, chiropractor, athletic trainer, massage therapist, perfusionist, doctor of Oriental medicine in any form, medical laboratory director or technician, or pharmacist, practicing within the scope of their license, and not using the titles “licensed dietitian” or “registered dietitian”, as long as they are providing nutrition information incidental to their primary profession.
